SUCCESSIONS A Succession is a legal proceeding that takes place after a loved one has passed away. When a person dies, certain legal papers have to be prepared and filed with the Court to place heirs in legal possession of a loved one's property. A Succession also ensures the decedent's outstanding taxes are paid. There are two types of successions: Testate and Intestate. · Testate succession: When a person dies with a Will, the Succession will be a "Testate Succession." The decedent has decided who shall receive his/her property and the Will determines the distribution of the property. · Intestate Succession: In this type of Succession, the decedent died without a Will and Louisiana Law controls which heirs will receive the decedent's property. Forced Heirs: Louisiana law has peculiar aspects in its heirship laws not found in other states. Under certain circumstances, a child may be an heir, regardless of the decedent's distribution of property in his/her Will.
